By creating an account or using BallotPop, you agree to these Terms of Service. If you do not agree, do not use the service. These terms apply to all admins who create and manage elections on BallotPop.
BallotPop is an online voting platform that allows organizations to create elections, collect votes by email, and publish results. We provide the technology — you are responsible for running your election in accordance with your organization's rules and any applicable laws.
You are responsible for maintaining the security of your account and for all activity that occurs under it. You must provide accurate information when signing up. You may not use BallotPop for any unlawful purpose or in a way that could harm other users or third parties.
You agree not to use BallotPop to:
We reserve the right to suspend or terminate accounts that violate these terms.
Elections cost $25, charged at the time you publish and send ballots. Payments are processed by Stripe. Because ballot emails are delivered immediately upon payment, we do not offer refunds after an election has been published. If you experience a technical failure that prevents your election from functioning, contact us at hello@ballotpop.com and we will work to make it right.
You retain ownership of the election content and voter information you upload to BallotPop. By using the service, you grant us permission to store and process that data in order to operate the platform. You are responsible for ensuring you have the right to use the email addresses you upload and to send election communications to those voters.
We take voter privacy seriously. Individual votes are anonymized when an election closes and results are published — voter identity is permanently removed from vote records at that point. See our Privacy Policy for full details.
We aim to keep BallotPop available and reliable, but we do not guarantee uninterrupted service. We are not liable for losses resulting from downtime, data loss, or service interruptions. For elections with time-sensitive deadlines, we recommend publishing with enough lead time to account for any unexpected issues.
BallotPop and its design, code, and branding are owned by us. You may not copy, resell, or repurpose any part of the platform without written permission.
BallotPop is provided "as is" without warranties of any kind, express or implied. We do not warrant that the service will be error-free or that results will meet any particular legal standard for official elections. BallotPop is designed for community organizations and is not intended for government or legally binding elections.
To the fullest extent permitted by law, BallotPop and its operators shall not be liable for any indirect, incidental, or consequential damages arising from your use of the service. Our total liability to you for any claim shall not exceed the amount you paid us in the 12 months prior to the claim.
We may update these terms from time to time. When we do, we will update the date at the top of this page. Continued use of BallotPop after changes constitutes acceptance of the updated terms.
